Jack Sargeant MS pushes for stronger bailiff regulations amidst growing concerns
Alyn and Deeside Senedd Member Jack Sargeant MS will today lead a debate in the Welsh Parliament on further regulation of debt collectors and bailiffs in Wales.
The initiative seeks to protect the public against the aggressions of an industry criticised for being under-regulated and rife with poor practice.
In collaboration with Citizens Advice Cymru, Jack Sargeant has encountered distressing stories of debt collectors neglecting vulnerable situations, coercing individuals into unaffordable repayment plans, and using intimidation. Such conduct underscores the dire need for regulatory reform.
There have been cases where individuals with mental health issues or other vulnerabilities have experienced undue distress because of bailiffs’ actions.
These incidents underscore the critical need for change, as the present regulations can lead to mental health strain and potentially dangerous situations for those involved.
During the Members’ Legislative proposal debate, Jack Sargeant will consider the introduction of backbench legislation and encourage the government to utilise its legislative authority for reform.
He stresses the importance of reform, particularly given that many debt collectors in Wales are contracted by local governments.
“In the midst of a cost-of-living crisis, the actions of debt collectors are worsening the hardship and placing incredible strain on people’s mental health,” Jack stated.
He has lamented the forceful methods used by debt collectors, including those from well-known companies like British Gas, on vulnerable individuals.
The Alyn and Deeside politician advocates for legislative changes to modify the operations of debt collectors and the methods councils use to recover debts.
Citizens Advice Cymru urges the Welsh Government to revise the regulations to prevent people from being required to pay their entire annual bill if they miss even one monthly payment, allowing local authorities to offer fairer and more affordable options.
They also seek the establishment of a statutory code of practice for council tax debt collection in Wales, enhancing the current Council Tax Protocol signed by all local authorities.
This would outline the steps local authorities should take before issuing a liability order, such as trying to establish an affordable repayment plan and assessing the individual’s vulnerability.
By endorsing Citizens Advice Cymru’s calls for regulatory changes, Jack aims to render council tax debt collection more humane and equitable.
