Welsh Government consults on leaseholder protections under new building safety law

The Welsh Government is consulting on how to put into practice new laws designed to stop leaseholders in Wales being billed for building safety failures they did not cause.

The Building Safety (Wales) Act 2026 passed the Senedd with unanimous support earlier this year.

The consultation, which opened this week, is the first step in turning that legislation into rules that will apply to residents living in multi-occupied buildings across Wales, including in Flintshire.

Three areas are covered.

The first is limits on what leaseholders can be charged when remediation work is needed on their building.

The second is a new tribunal system, which would give residents and building owners a formal route to resolve disputes about who pays for remediation work, and how much.

The third is a method for calculating the height of regulated buildings, which determines which properties fall within scope of the new rules.

Siân Gwenllian MS, the Cabinet Minister for Local Government, Housing and Planning, said:

“No leaseholder in Wales should pay for building safety failures they did not cause, and those failures should be rectified as soon as possible.

“This consultation is a crucial step in making sure the Building Safety (Wales) Act 2026 delivers real protection for the people it was designed to serve.”

The minister also referenced the anniversary of the Grenfell Tower fire, saying the Welsh Government had a duty to turn the legislation into lasting change.

The Grenfell Tower fire in London, on 14 June 2017, killed 72 people and led to a prolonged national review of fire safety standards in high-rise residential buildings.

The consultation is open to residents, leaseholders, building owners and all other interested parties.

It closes on 7 September 2026.
